Privacy Notice - Market Traders
South Hams District Council takes your privacy seriously.
We will use your information in order to process your market trader application. This notice sets out what we will do with your personal information and who we may share it with in respect of the above.
What information about you do we collect?
We collect the following information:
- Name
- Address
- Phone Number
- Emergency contact phone number
- Email Address
- Public Liability Insurance
How do we collect information about you?
Relevant personal data will be collected:
- Directly from you as the data subject
How will your personal data be used?
Your personal data will be used in the following ways:
- For the management of our Markets
- For the application process
- To complete any agreements we may make with you
- For identification purposes
- To communicate with you
- To check eligibility to work in the United Kingdom
- To evidence you have appropriate public liability insurance
The Legal basis for processing your data
Article 6 1(b)
Processing is necessary for the performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract.
You have entered into a contract with us to enable you to trade at our Market as a market trader.
Article 6 1(c)
Processing is necessary for compliance with a legal obligation to which the controller is subject and Article 6 1(e) processing is necessary for the performance of task carried out in the public interest or in the exercise of official authority vested in the controller.
The public tasks we carry out, and the legal obligations we are subject to, are found in the:
- Highways Act 1980
- Local Government (Miscellaneous Provisions) Act 1982 - Schedule 2
Who will your personal data be shared with?
We may share your personal data with the following organisations:
- National Fraud Initiative (NFI)
- Other Government Departments
- HMRC for Tax and National Insurance purposes
- Law enforcement agencies
- Home Office
- Other External Agencies (e.g. Credit Referencing Agencies)
The Council will never sell your data to anyone else.
Transferring of data outside the EU
Your data will not be transferred outside the EU. It will be securely stored electronically within the UK only, unless it was necessary for safeguarding or for the prevention and detection of crime.
Length of time we keep your information
The Councils will retain personal data for no longer than 6 years from the date the licence expires or the date of the resolution of enforcement action, in accordance with the Limitation Act 1980 (Schedule 2).
