Off-Street Parking Places (Variation Number 2) Order 2021

NOTICE is hereby given that on 13th October 2021 South Hams District Council ("the Council") in exercise of its powers under section 32, 33 and 35 of the Road Traffic Regulation Act 1984 ("the 1984 Act") and any other enabling powers made the above Order:

The Order will come into operation on 1st November 2021.

The effect of the Order is to vary the South Hams District Council (Off-Street Parking Places) Order 2021:

  • Apply a maximum stay of three hours no return within two hours at Follaton House car park (bays located outside arboretum) as referenced under Article 7 and Schedule 2 Annex 3 of the South Hams District Council (Off-Street Parking Places) Order 2021
  • Apply a maximum stay of three hours no return within two hours to the electric charging points located at Follaton House as referenced under Article 7 and Schedule 2 Annex 3 of the South Hams District Council (Off-Street Parking Places) Order 2021
  • To amend Article 28 of the South Hams District Council (Off-Street Parking Places) Order 2021 to state: A Pay and Display Ticket issued by a Pay and Display Machine or through the Ticketless Facility following payment of the Parking Charge shall:
    • a. Only be valid within the Parking Place in which it was purchased, unless otherwise specified;
    • b. Only be valid until the expiry time shown on the Pay and Display Ticket or the receipt from the Ticketless Facility;
    • c. Shall not be transferred between vehicles; and
    • d. Only be used in the vehicle registration number entered into the Pay and Display Machine or through the Ticketless Facility by the driver at the time of purchase

Due to reasons connected to the effects of coronavirus, including restrictions on movement, the Council has made a copy of the Order and amendments available for public inspection on the Council's website at
www.southhams.gov.uk. Alternatively, if you require a copy to be sent to you please call the Council on 01803 861234 or email a request to Parking@swdevon.gov.uk.

Any person wishing to question the validity of the Order or of any provision contained in it, on the grounds that it is not within the powers conferred by the Road Traffic Regulation Act 1984 or of any Regulations made under the Act has not been complied with may, within six weeks from the date on which the Order was made apply for that purpose to the High Court.

Off Street Parking Place (Variation Number 2) Order 2021

South Hams District Council ("The Council") exercising its powers under the Road Traffic Regulation Act 1984 ('the 1984 Act') and of all other enabling powers with the consent of Devon County Council and after consulting the Chief Officer of Police makes the following order:

1.0 Commencement, citation and definitions

1.1 This Order shall be supplementary to the South Hams District Council (Off Street Parking Places) Order 2021 ("the Principle Order") which except as amended by the Order will remain in full force and effect.

1.2 This Order shall come into operation on 1 November 2021 and may be cited as the 'South Hams District Council (Off Street Parking Places)(Variation No2) Order 2021.'

1.3 The Definitions are set out in the Principle Order.

2.0 Amendments to the Principle Order

2.1 the Principle Order is amended as follows:

2.1.1 Apply a maximum stay of three hours, no return within two hours at Follaton House car park (bays located outside arboretum) as referenced under Article 7 and Schedule 2 Annex 3 of the South Hams District Council (Off-Street Parking Places) Order 2021,

2.1.2 Apply a maximum stay of three hours, no return within two hours to the electric charging points located at Follaton House as referenced under Article 7 and Schedule 2 Annex 3 of the South Hams District Council (Off-Street Parking Places) Order 2021 and to 

2.1.3 Amend Article 28 of the South Hams District Council (Off-Street Parking Places) Order 2021 to state: A Pay and Display Ticket issued by a Pay and Display Machine or through the Ticketless Facility following payment of the Parking Charge shall:
