Communities can shape development in their areas through the production of Neighbourhood Development Plans.

What is a Neighbourhood Plan?

Neighbourhood planning is a right for communities introduced through the Localism Act 2011. Communities can shape development in their areas through the production of Neighbourhood Development Plans, Neighbourhood Development Orders and Community Right to Build Orders.

How do I prepare a Neighbourhood Plan?

There are procedures that communities must go through to prepare a Neighbourhood Development Plan or Order. These are set out in detail in the government's Neighbourhood Planning Regulations 2012, then revised in Neighbourhood Planning Regulations 2015.

The basic steps are as follows:

1. Set up a Neighbourhood Planning Group and designate a plan area.

The Parish/Town Council is responsible for setting up a group which will prepare the plan in the community. Once membership of the group is agreed, the Parish/Town Council will need to send an Icon for pdf application to designate an area [82.73KB] to the Council to designate a plan area. This is the geographic area the plan will cover.

If the proposed area follows an existing town or parish boundary, applications will be the subject of a 4-week consultation period.  Areas that do not follow existing boundaries, or include more than one town or parish, will be subject to a 6-week consultation period.

Your application form should be accompanied by a Terms of Reference, describing how a neighbourhood planning group will manage the process of writing a plan, who will be involved and how the group will work alongside the appropriate town or parish council.

2. Collect evidence and consult the community.

It is really important that your plan uses both community opinion and factual evidence. Your plan should collect information using a range of surveys, studies and community events to fully understand the issues in your community.

3. Write a plan for your area.

Once you have gathered information and ideas from the community and have fully understood the development needs of the area, you will need to prepare a draft plan. Everyone in your community should be given the opportunity to comment on the draft plan before it is sent to the Council.

4. Examination and Referendum

The Council will make arrangements to carry out an independent examination of the plan. If the plan is found 'sound' by the examiner, the District Council will organise a referendum. People living in the area who are registered to vote will be able to vote in support of, or against, the plan.

Support for Communities

The ultimate responsibility for a neighbourhood development plan or order sits with the town or parish council - known as the 'accountable body'.  The accountable body is also responsible for ensuring that the process is demonstrably led by the community, and that this can be clearly evidenced. The Council will offer general guidance and advice as appropriate, and the level of support will be proportionate to the scale and scope of each neighbourhood plan.
