Archive - Independent Examination into the Sherford Area Action Plan
The hearing part of the Examination is now closed and the Inspector's binding report was received by the Council in July 2007, the Council resolved to adopt the AAP on 2 August 2007.

An Independent Examination into the representations received to the Sherford Area Action Plan Submission Stage commenced on Tuesday 23 January 2007 at South Hams District Council Offices at Follaton House, Plymouth Road, Totnes. The purpose of the Examination was for an independent Inspector to assess whether the South Hams LDF Sherford Area Action Plan is “sound”. The Inspector will produce a report on the Examination which will be binding upon the Council.

The Inspector

The First Secretary of State has appointed Mr Nigel Payne BSc (Hons) DipTP MRTPI MCMI as the independent Inspector to conduct the Examination.

The Programme Officer

Karen Boyle has been appointed as Programme Officer for the Examination and will deal with all procedural, administrative and programming matters. The Programme officer is independent of the Council and works directly to the Inspector. All correspondence should be addressed to her. The Pre-Examination Meeting (PEM)

The Inspector held the Pre-Examination Meeting into the Sherford AAP on 21st November 2006 at the Council offices at Follaton House, Plymouth Road, Totnes. The purpose of the PEM was to discuss the management, administration and process of the Examination.

The Examination Library

The Examination Library will consist of the Core Documents, Representations, Plan Documents and subsequent material submitted to the Examination by all parties. The library is maintained by the Programme Officer. All documents are available to view by the public, by prior appointment with the Programme Officer.

Core Documents

The Core Document list details all the documents that may be called upon during the Examination.  This list will be updated on a regular basis, as the Further Submissions are received.

The Council has prepared the following topic papers which set out the Council’s position for the Examination:

Programme for the Examination

Those who have made representations on the Sherford AAP should have already decided whether their views can be dealt with in a written form or whether they need to come and present them orally at the hearing session.  Both methods will carry the same weight and the Inspector will have equal regard to views put orally or in writing.

The Inspector has prepared a Draft Programme for the Examination. This will be updated regularly.

Statements for the Hearing (Further written representations)

Respondents participating in a hearing session must, in accordance with the timetable, prepare a statement of their position, focused upon the issues identified and circulated in the agenda for that session.

Those people who proceed by written means need take no further action.

Respondents can submit further written evidence in support of their position, these submissions should focus upon the issues identified in the hearing session agendas and to the same timetable.

The Addendum was published on 22nd February 2007 for a 6 week consultation period until 5th April 2007.

Re-Opening of the Examination

The Examination will re-open on the 24th and 25th April at Follaton House to consider the review of the Sherford Area Action Plan Sustainability Appraisal.
