Disabled Drivers
The Council realises that being disabled does cause problems whilst using our service and visiting the area. In February 2004 the Council decided that it should charge the disabled for car parking and thus a policy was adopted which enables blue badge holders to an extra hour over and above the parking time purchased and that the severely disabled who hold tax exempt road fund discs should be entitled to 3 hours free car parking in all our car parks.
This policy was adopted only after extensive benchmarking was completed with other local authorities and after consultation with a number of disabled action groups. The Council understands that being disabled means it takes longer to under tasks such as shopping, visiting attractions etc but that it does not mean an inability to pay the standard fees.
Further to this policy being adopted the Council introduced discounts for the disabled on parking permits of 25%, 30 minute and hourly pre-payment vouchers are now also available from Follaton House which allows disabled customers the convenience of not visiting the pay and display meter in all car parks.
Abandoned Vehicles
An abandoned vehicle is a vehicle without a known owner. The Council has a duty to remove abandoned vehicles, which are dealt with under the Removal and Disposal of Vehicles (England) (Amendment) Regulations 2002 and the Refuse Disposal (Amenity) Act 1978.
The fact that a vehicle is untaxed does not necessarily mean it has been abandoned. The enforcement authority for untaxed vehicles is the Driver and Vehicle Licencing Agency (DVLA) which has its own prosecution officers. The DVLA can be contacted on the Road Tax Cheat line 08000 325202.
A notice is fixed to any vehicle deemed to be abandoned and the time that must elapse before the vehicle is removed depends on its location and condition.
The council takes a robust approach to abandoned vehicles. Residents who wish to report an abandoned vehicle are requested to give the following details on 01803 861234
- a contact name or contact telephone number
- the make, model and colour of the vehicle in question
- the registration of the vehicle if known
- the nearest town and exact location of the vehicle, which is important
- confirmation as to whether there is a tax disc displayed and if so, the date on the disc
- the condition of the vehicle, giving details of any damage or missing parts

How to appeal (Stage 1)
All appeals must be in writing, quoting the Penalty Charge six digit number on all correspondence, no appeals will be considered without supporting evidence. If you can provide a ticket/permit/blue badge that is valid at the time the Penalty Charge is issued then enclose a cheque in the sum of £5.00 (cancellation charge) payable to South Hams District Council with this evidence. All appeals will be held at £70.00 during the procedure. Ticket numbers will be checked and all other evidence considered then all appellants will be informed of the outcome in writing.
Please note that the department will not enter into verbal discussions regarding the details of your appeal.
If you are unhappy with an appeal decision then :-
Stage 2
If you are not happy with the result of the initial appeal you can then write to the Car Parks Manager at the above address, detailing your reasons.
Stage 3
If you are still unhappy the final appeal stage should be addressed in writing to the Head of Business Development at the above address.
Cost of Penalty Charge
- Paid within 7 days of issue date excluding appeals: £35.00*
- Paid after 7 days of issue date & all appeals: £70.00
- Cancellation fee: £5.00
Failing to pay the Penalty Charge will result in further costs and legal action.
* 50% discounted amount of £35.00 is a fast track payment which must be received by the office within 7 days from the issue date of the Penalty Charge. No correspondence received with this discounted payment will be acknowledged.
