Bailiffs

 

  1. Bailiffs will attempt to collect the debt on our behalf and in the first instance they will try to do this by reaching agreement with you on when and how to pay. But at this late stage any arrangement to pay is unlikely to stretch for more than a few weeks.
     
  2. In order to re-enforce any arrangement they will probably place a ‘levy’ on some of your possessions. This means that, should you break the agreement, they have the power to remove the goods and sell them at public auction. They may also do this if they are unable to agree any payment plan with you in the first place.
     
  3. They are not allowed to levy on some goods, if you need them for your employment for example, or household equipment and furnishings required to meet the basic domestic needs of your family such as beds, cooker, etc...
     
  4. As well as a basic fee the bailiff will also charge you for each visit they make.
     
  5. If the bailiffs are unable to collect the debt they will return the Liability Order to us with an explanation setting out the reasons. We will then have to consider other options open to us to collect the debt such as bankruptcy, placing a charging order on your property, or committal proceedings.
