Expert Planning System

Expert Planning System - a new service that is provided so a resident can determine whether or not they would require planning permission. The system at the moment deals with householder enquiries, i.e. queries such as; do I require planning permission to build a porch on my house?
Currently no commercial or agricultural queries are covered.

This service can be completed online without any need to contact the council and gives the user an insight into how Planning permission decisions are made by providing simple questions and allowing users to locate their property by interactive maps.
*Information is presented to the user in an easily usable format, with simple navigation throughout the system clearly explaining what actions they need to take. Definitions of any terms that may need explanation are also provided.

The advice that is provided at the end of the system is based on the answers that the user provides, and the advice given is in no way a lawful certificate.

As a user it is advised that you have certain property details at hand when going through the system i.e. whether the property falls within a conservation area or is a listed building. Depending on your query you may need more detailed information to receive an answer i.e. for extensions/new buildings you will need to know the dimensions of the proposal and the position in relation to the highway. Based upon the answers that you give, the process could take several minutes.

About the System

Welcome to South Hams District Councils Householder Expert Online System. To use the system some or all of the following information will be required.

  • The location where the proposal is to take place (you will need to know the POSTCODE).
  • Details of what you are proposing to do e.g. build an extension, install a satellite dish.
  • For extensions / new buildings you will need to know the dimensions of the proposal and the position in relation to the highway

What the system will do next: Once you have selected the correct address you will be shown a map to confirm the location. You will then be presented with a series of questions relating to the proposal you have in mind. Depending on your answers, the process could take several minutes.

The system will

  • Answers commonly asked queries for a householder.
  • Give you informal advice on the information you have given.
  • Provide you with a unique Session ID number that you can keep for your records.
  • Explain the technical terms.
  • Provide advice based on Permitted Development Rights NOT being removed from a property.

The system will not

  • Provide advice if the proposal is outside of the boundary of the property.
  • Give you a formal determination i.e. a Lawful Development Certificate.
  • Include advice for Change of Use, Agriculture, Building Regulations or Commercial, only Operational Development. i.e. Building Works

*The maps used in this system are provided by South hams District Council under license from the Ordnance Survey in order to fulfill its public duties to promote the district and inform the public of District Council activities.

Alternatively, you can complete the Adobe Acrobat Document -- will open in new browser window Permitted Development enquiry form.  Your request should be accompanied with a fee of £40.00, cheques should be made payable to South Hams District Council.  When your form and payment has been received we will acknowledge and the request will be passed to an appropriate Officer for response.

As well as planning permission, you may need building regulations approval, so check on this before you start work. In many cases, planning permission may not be required, but building regulation approval could be. The Planning Portal is intended to be the first point of call for anyone who wants to find out about the planning system in England and Wales. It can help you find out if planning permission is required; has handy calculation tools and a satellite dish locator; and when/if you have found out you require planning permission you are able to Apply On-Line if you wish.
